Transgender director Sam Feder's recent feature "Heightened Scrutiny" provides a powerful two-part perspective – both an personal profile of a key transgender activist and a sharp examination of media reporting surrounding transgender issues.

Legal Struggle at the Supreme Court

This documentary follows ACLU lawyer Chase Strangio as he prepares for legal presentations in the important highest court case the Skirmetti case. This legal battle happened in late 2024, with the judiciary finally ruling in favor of Tennessee's argument, practically allowing limitations on treatment for transgender young people to stay in place across numerous US territories.

We created Heightened Scrutiny in merely 16 months, stated Feder during a discussion. By contrast, my previous film Disclosure took me half a decade, so this was very accelerated. Our goal was to generate dialogue so people would learn more about the case.

Personal Narrative Amid Political Battle

While Feder presents a comprehensive critique of how prominent media outlets have promoted anti-trans rhetoric, the film's primary accomplishment may be its engaging portrayal of Strangio. Typically a cautious lawyer in media settings, Strangio shows his authenticity throughout the documentary.

That was a substantial challenge, to open up aspects of my life to a camera lens that I had worked hard to keep confidential, stated Strangio. Feder said he wanted the next generation to know that we struggled, to see what was done in defense of these fights for our material survival.

Varied Perspectives in the Movement

To support Strangio's account, Feder incorporates various transgender activists, such as well-known individuals from activism and entertainment. This film also features perspectives from cisgender supporters who analyze how respected organizations have contributed to negative coverage of transgender people.

The viewpoint of trans minors central to the court battle is shown through a impressive young girl named Mila. Viewers observe her fighting for her fellow students at a school board meeting, with subsequent scenes showing her demonstrating for transgender rights outside the Supreme Court.

Intimate Moments Beyond the Courtroom

The documentary also features touching moments where Feder transcends the ongoing political battle, including sequences of Strangio traveling in Italy and receiving a tattoo featuring lines from activist Pauli Murray's poem "Prediction."

This ink sequence is among my most cherished sections in the movie, stated Strangio. Receiving body art is almost like a meditative experience for me, to be fully present in my body and to think of it as a vehicle for things that are significant to me.

Body Identity and Representation

The filmmaker's focus to carefully documenting Strangio getting to his body art underscores that this documentary is essentially about transgender physical selves – not just those of young people who face restriction of their ability to live genuinely in their own bodies, but also the physical forms of the numerous participants who are featured in the production.

I make films with a message, and part of that is choosing people who are exceptional and articulate enough to sustain the camera, explained Feder. Whenever people ask me what they should wear for an filming, my answer is whatever makes you feel confident. This is essential to me – as trans people, we struggle so much with our appearance.

Impact and Hope

One aspect that makes Feder's films stand out is his obvious skill for making his trans subjects feel comfortable, acknowledged and admired. This methodology fosters real chemistry between Feder and Strangio, allowing the director to realize his objective of showing Strangio as a whole person and leaving a record for future generations of how determinedly he and fellow activists have struggled for trans liberties.

I don't want people to find themselves in a state of incessant discouragement because of what the law is failing to provide us, shared Strangio. I strive to be in a practice of using the law to minimize harm, but not to turn it into some sort of conduit for our liberatory possibilities. The government is not going to be the mirror through which we view ourselves. Our community are that reflection, and it's really crucial that we continue having that dialogue in addition to dialogues about fighting back these regulations and practices.
